Contrast Terms of Use

1. Agreement
These Terms of Use (the “Terms”) are an agreement between you and Nordeste Digital LLC (“we,” “us,” or “our”) governing your use of the Contrast mobile application (the “app”). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
2. Who May Use the App
The app is a tool for adults — parents and caregivers. You must be old enough to hold an account with the app store you downloaded the app from. You operate the app and are responsible for how your device is used around your child, including following the guidance shown in the app: short, supervised sessions; a comfortable viewing distance; and low volume with the device kept away from your baby.
3. Not Medical Advice
The app displays high-contrast images and plays sounds. It is not a medical device and does not provide medical, health, or developmental advice, diagnosis, or treatment, and it makes no claims about outcomes for your child. It is not a substitute for your own attention and care or for professional advice. If you have any concerns about your child's health or development, consult your pediatrician.
4. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the app or its content, and you may not reverse-engineer the app except to the extent applicable law permits it despite this restriction.
5. Premium Purchase
The app offers an optional one-time, non-consumable in-app purchase (“Premium”) that unlocks all card packs and removes advertising. The purchase is billed by the Apple App Store or Google Play under their own terms, and the price shown in the store at the time of purchase applies. Premium is not a subscription and does not renew. To re-enable Premium on another device signed in to the same store account, use Restore Purchases on the paywall or in the app's settings.
6. Refunds
Purchases are processed by the app store, and refunds are handled through the store you purchased from. For the Apple App Store, request a refund from Apple at reportaproblem.apple.com. For Google Play, refunds follow Google Play's refund policy; you can request one through the Play Store or by contacting us. We do not receive your payment details and cannot charge or refund your payment method directly.
7. Advertising
The free version of the app displays banner advertising provided by Google AdMob on parent-facing menu screens only. How advertising data is handled, and your choices, are described in the Privacy Policy. The Premium purchase removes ads.
8. Intellectual Property
The app and all content in it — including the card artwork, sounds, text, and software — are owned by Nordeste Digital LLC or its licensors and are protected by copyright and other intellectual-property laws. These Terms do not grant you any rights other than the license in Section 4.
9. Acceptable Use
You agree not to use the app for any unlawful purpose, not to interfere with or disrupt the app or the services it relies on, and not to misrepresent your relationship with us.
10. Disclaimer of Warranties
The app is provided “as is” and “as available,” without warranties of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
11. Limitation of Liability
To the maximum extent permitted by law, Nordeste Digital LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or relating to your use of the app. To the maximum extent permitted by law, our total liability for all claims relating to the app will not exceed the amount you paid us for the app in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
12. Termination
You may stop using the app at any time by uninstalling it. We may suspend or end support for the app, or terminate this license if you materially breach these Terms. Sections 8, 10, 11, and 14 survive termination.
13. App Store Terms
If you downloaded the app from the Apple App Store: these Terms are between you and Nordeste Digital LLC only, not with Apple; Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it; in the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded the app from Google Play, your use is also subject to the Google Play Terms of Service.
14. Governing Law
These Terms are governed by the laws of the United States and of the state in which Nordeste Digital LLC is organized, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer rights you have under the mandatory laws of the place where you live.
15. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated date, and material changes will be noted in the app's release notes. Continuing to use the app after a change takes effect means you accept the updated Terms.
